1. INTRODUCTION
Welcome to Cradlux ("Company," "we," "us," or "our").
Cradlux operates this website and online store, including all related content, information, tools, products, and services (collectively, the "Services"). The Services are hosted and powered by Shopify Inc.
These Terms of Service ("Terms") constitute a legally binding agreement between you and Cradlux and govern your access to and use of the Services, as well as the purchase and use of any products offered through the Services.
BY ACCESSING, USING, OR PURCHASING FROM THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS, INCLUDING THE ARBITRATION AGREEMENT AND CLASS ACTION WAIVER SET FORTH BELOW.
If you do not agree to these Terms, do not use the Services.

3. ELIGIBILITY
By using the Services, you represent and warrant that:
You are at least 18 years old
You have the legal capacity to enter into a binding agreement
All information you provide is accurate and current
Purchases are for personal, non-commercial use only, unless expressly authorized in writing by Cradlux
We reserve the right to refuse service, cancel orders, or terminate access for violations of these Terms.
You are responsible for all activity conducted under your account.
4. PRODUCT CATEGORY AND INTENDED USE
The Cradlux device is a USB-rechargeable consumer electronics product that plays ambient audio (white noise and nature sounds) and emits a soft, pulsing warm amber breathing light. It is intended solely for use as a nursery aid by adult caregivers to help create a calm sleep environment for infants.
The product:
Is a general consumer electronics device and is not a medical device, baby monitor, or safety device
Is intended to be operated and placed by adults on a stable flat surface outside the infant's sleep area — not inside the crib, bassinet, or any sleep surface
Does not function while connected to a charging cable; the charging cable must be kept out of reach of infants and removed from the nursery area before device operation
Features an automatic sleep timer (15, 30, and 60 minutes) to limit unattended extended operation
Is designed for placement at a safe distance from the infant, consistent with current pediatric audio safety guidance
5. INFANT SLEEP SAFETY
The Cradlux device does not alter, replace, or supplement safe infant sleep practices.
Use of this product does not reduce or eliminate the risk of Sudden Infant Death Syndrome (SIDS), suffocation, entrapment, overheating, or any other sleep-related infant safety risk.
You must follow current American Academy of Pediatrics (AAP) safe sleep guidelines at all times, independently of and in addition to any use of this product. These include, without limitation:
Always place infants on their back on a firm, flat sleep surface
Use a crib, bassinet, or play yard that meets current CPSC safety standards, with a firm mattress and a fitted sheet
Do not place this device, its charging cable, or any other object inside or directly adjacent to the infant's sleep area, including inside the crib or bassinet
Do not position the device where it could fall onto or near the infant's sleep area
This product provides no monitoring, alert, or supervisory function of any kind; adult supervision remains the sole means of monitoring an infant
Compliance with AAP safe sleep guidelines is the sole responsibility of the adult caregiver. Cradlux accepts no liability for infant injury or death arising from failure to follow safe sleep guidelines.
6. SOUND LEVEL SAFETY
This product emits sound at a level selected by the adult user. Protecting infant hearing is the responsibility of the adult caregiver.
To protect infant hearing, you must:
Keep the device at a distance of at least 6 feet (approximately 2 meters) from the infant's ear level, consistent with current American Academy of Pediatrics guidance on infant sound machine use
Do not operate the device at maximum volume
Use the built-in auto-shutoff timer rather than leaving the device running continuously throughout the night
Follow your pediatrician's specific guidance on sound machine use for your infant
Prolonged or excessive sound exposure can damage infant hearing, including at levels that may not be perceptible as loud to adults. We make no representation that use of this product at any specific volume level or distance is safe for any particular infant. Individual sensitivity varies.
Any concern about sound levels or your infant's hearing must be directed immediately to a licensed pediatrician or healthcare provider.
7. ELECTRICAL AND BATTERY SAFETY
This product contains a built-in lithium-ion rechargeable battery. By purchasing and using this product, you acknowledge and agree to the following:
Do not use the device while it is connected to a charging cable; remove the cable and store it out of reach of infants before use
Do not expose the device to water, liquids, moisture, or extreme temperatures
Do not cover or obstruct the device during operation
Discontinue use immediately and contact us if the device is physically damaged, shows signs of battery swelling, emits unusual heat, produces burning odors, or behaves abnormally
Do not attempt to open, disassemble, modify, or repair the device
Dispose of the device in accordance with local electronic waste (e-waste) regulations at the end of its useful life; do not dispose of in household waste
Lithium-ion batteries require safe handling and proper disposal. For battery safety questions, consult your local hazardous waste authority.
8. LIGHT SAFETY
The Cradlux device emits a soft pulsing warm amber light intended as dim ambient nursery illumination.
Do not aim or direct the light source directly at the infant's eyes.
The light is designed for ambient use only and is not a medical, phototherapy, or therapeutic light device. If your infant displays sensitivity to light or you have any concern about light exposure, consult a licensed pediatrician before use.
9. NO MEDICAL CLAIMS
The Cradlux device is a general consumer electronics product.
It is:
NOT a medical device
NOT FDA-cleared, FDA-approved, or FDA-registered as a medical device, medical aid, or therapeutic device
NOT intended to diagnose, treat, cure, mitigate, or prevent any disease, disorder, developmental condition, or medical condition in infants or adults
NOT intended to prevent or reduce the risk of SIDS, suffocation, or any sleep-related safety risk
NOT a substitute for professional medical advice, pediatric guidance, or licensed healthcare services of any kind
Any information on the Services relating to infant sleep, white noise, or breathing light effects is for general informational purposes only. It does not constitute medical advice and must not be relied upon as a substitute for consultation with a licensed pediatrician or healthcare provider.
Individual experiences with infant sleep vary widely and depend on many factors unrelated to any product. No specific outcome is guaranteed.
10. PRODUCT SAFETY AND COMPLIANCE
This product is designed for consumer use and is sourced from third-party manufacturers. We require our manufacturing partners to provide products that comply with applicable U.S. consumer product safety requirements, including:
FCC Part 15 (radio frequency and electronic device emissions)
Applicable CPSC regulations and safety standards for consumer electronic products
Applicable ASTM standards where relevant to this product category
Any certifications, test reports, compliance documentation, or safety representations relating to the materials, electronics, assembly, or performance of the product originate from the supplier or manufacturer and are supplier representations only. They are not independent compliance attestations made by Cradlux.
No representation or warranty is made by Cradlux that the product meets all applicable safety standards under all conditions of use.
CALIFORNIA PROPOSITION 65 WARNING: This product can expose you to chemicals including lead and phthalates, which are known to the State of California to cause cancer, birth defects, or other reproductive harm. For more information, go to www.P65Warnings.ca.gov.
11. ASSUMPTION OF RISK
You voluntarily assume all risks associated with the use or misuse of the product, including but not limited to:
Hearing risks from operating the device at excessive volumes or insufficient distances from the infant
Electrical risks associated with the device's battery, charging cable, or power supply, particularly when used in proximity to an infant
Risks arising from placement of the device in the infant's sleep area contrary to the instructions in these Terms
Risks arising from failure to follow AAP safe sleep guidelines, the safety instructions in these Terms, or the instructions provided with the product
The possibility that the device has no effect, a different effect than expected, or an unintended effect on infant sleep
Any injury, loss, or damage arising from misuse, improper placement, unauthorized modification, or failure to discontinue use upon observing any problem
Your purchase and use of this product constitutes your voluntary assumption of these risks.
12. PRODUCT PRESENTATION DISCLAIMER
Product images, videos, descriptions, testimonials, and marketing materials are for illustrative purposes only.
Actual product appearance, materials, packaging, or performance may vary.
Testimonials and reviews reflect individual experiences and do not represent typical results. Results shown in marketing materials are not guaranteed and will vary based on many individual factors. No representation is made that any testimonial result is typical or achievable by consumers generally.
We reserve the right to modify or discontinue products at any time without notice.
13. ORDERS AND BILLING
All orders constitute an offer to purchase and may be accepted or rejected at our discretion.
Orders generally cannot be modified or canceled once placed.
You authorize us to charge your selected payment method for all amounts due.
We reserve the right to cancel orders suspected of fraud, abuse, or unauthorized resale.
14. SHIPPING AND INTERNATIONAL FULFILLMENT
Orders ship directly from international fulfillment partners, primarily located in China, to the customer in the United States. Goods do not transit through Germany at any point.
Cradlux does not maintain warehousing, retail, or fulfillment operations in either the United States or Germany.
You acknowledge that:
Delivery times are estimates, not guarantees
Delays due to customs or carriers may occur
Accurate shipping information is your responsibility
Orders marked as delivered by the carrier are considered fulfilled
15. RETURNS AND PAYMENT DISPUTES
Returns and refunds are governed by our Refund Policy, including the 30-day satisfaction guarantee.
We reserve the right to contest improper chargebacks or abusive dispute behavior.
Customers engaging in excessive or fraudulent disputes may be refused future service.
16. USER CONTENT LICENSE
By submitting reviews, images, videos, or other content, you grant Cradlux a perpetual, worldwide, royalty-free, irrevocable license to use such content for marketing, promotional, and business purposes.
17. INTELLECTUAL PROPERTY
All content on the Services is owned by Cradlux or its licensors and protected by intellectual property laws.
Unauthorized use is prohibited.
18. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE".
WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
19. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:

WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM USE OR MISUSE OF THE PRODUCT.
20. INDEMNIFICATION
You agree to indemnify and hold Cradlux harmless from any claims, damages, or expenses arising from misuse of the product or violation of these Terms.
21. INFORMAL DISPUTE RESOLUTION
Before initiating arbitration, you agree to contact support@cradlux.com and allow 30 days for informal resolution.
22. ARBITRATION AND CLASS ACTION WAIVER
Any dispute shall be resolved by binding arbitration under the Federal Arbitration Act, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
Arbitration shall be conducted on an individual basis
No class actions or representative claims
Arbitration may take place remotely or in New York, New York
Small claims court remains permitted
Opt-Out: You may opt out within 30 days of purchase by emailing support@cradlux.com with your full name and order number.
23. GOVERNING LAW
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, and without depriving consumers of mandatory rights under applicable consumer protection laws, including those of their state of residence.
24. ELECTRONIC COMMUNICATIONS
You consent to receive communications electronically.
25. FORCE MAJEURE
We are not liable for delays or failures caused by events beyond our reasonable control.
26. SEVERABILITY AND ENTIRE AGREEMENT
If any provision is deemed invalid, the remaining provisions remain enforceable.
These Terms constitute the entire agreement between you and Cradlux.
